App Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Clear Clinics mobile application (“App”). By downloading, accessing, or using the App, you agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not use the App.

The Clear Clinics App is a clinical support and workflow platform designed for trained healthcare professionals. Features may include (but are not limited to):

• Endoscope camera integration
• Patient consent capture
• Image and video storage
• Treatment documentation
• Hearing screening tools (where enabled)
• Secure data synchronisation
• Practice and contractor management features

The App does not provide medical diagnosis or clinical decision-making and is intended to support trained professionals only.

To use the App, you must:

• Be at least 18 years old
• Be a healthcare professional or contractor authorised by Clear Clinics
• Provide accurate and complete registration information
• Keep your login credentials secure

You are responsible for all activity carried out under your account.

Clear Clinics reserves the right to approve, suspend, or terminate accounts at its discretion.

Clear Clinics grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for professional purposes only.

You must not:

• Copy, modify, reverse engineer, or resell the App
• Use the App for unlawful or unauthorised purposes
• Allow unauthorised third parties to access your account

• The App is a support tool only
• Clear Clinics does not provide medical advice via the App
• Clinical responsibility remains entirely with the practitioner
• You must ensure you are appropriately trained, insured, and competent
• The App does not replace professional judgement, clinical guidelines, or patient safeguarding duties

You confirm that:

• You have obtained valid patient consent before recording, storing, or uploading any patient data
• You comply with all applicable data protection laws, including UK GDPR
• You are authorised to process patient data within the App

Clear Clinics acts as a data processor, while you (or your organisation) remain the data controller unless otherwise agreed in writing.

Clear Clinics uses secure, encrypted systems to store data in accordance with industry standards.

• No system is completely risk-free
• Clear Clinics does not guarantee uninterrupted or error-free service
• You are responsible for maintaining local backups where required

Some App features may require payment, including:

• Subscriptions
• Feature unlocks
• Additional storage or modules

All fees:

• Are clearly displayed before purchase
• Are non-refundable unless required by law
• May change with reasonable notice

Failure to pay may result in restricted access or account suspension.

• Release updates, bug fixes, and improvements
• Add, modify, or remove features
• Require mandatory updates for security or compliance reasons

Continued use of the App constitutes acceptance of updates.

The App is provided on an “as is” and “as available” basis.

Clear Clinics does not guarantee:

• Continuous availability
• Compatibility with all devices
• Error-free performance

Maintenance, outages, or third-party issues may occur.

All intellectual property rights in the App, including:

• Software
• Branding
• Logos
• Content and workflows

remain the property of Clear Clinics Limited or its licensors.

No rights are transferred to users except as expressly stated.

Clear Clinics may suspend or terminate your access if you:

• Breach these Terms
• Misuse patient data
• Act in a way that risks patient safety or brand integrity
• Fail to pay applicable fees

Upon termination:

• Your licence ends immediately
• Data retention follows legal and regulatory requirements

To the maximum extent permitted by law:

Clear Clinics shall not be liable for:

• Clinical outcomes
• Loss of income, data, or reputation
• Indirect or consequential losses
• User error or misuse

Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.

You agree to indemnify Clear Clinics against any claims, losses, or liabilities arising from:

• Your clinical practice
• Breach of data protection obligations
• Misuse of the App

Clear Clinics may update these Terms from time to time.

• Changes will be communicated via the App or email
• Continued use after changes means acceptance

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the English courts.
